Variation to Terms and Conditions

  1. Spiegel Haus Melbourne may update, vary or replace these Terms and Conditions at any time, including for specific events. Any changes will be made effective by posting them on the Spiegel Haus Melbourne website at WEBSITE.com. By purchasing a ticket through Universe or an authorised sales channel, you agree to be bound by the Terms and Conditions in effect at the time of purchase.

Purchase of Tickets

Tickets are only valid when purchased through Universe, including directly from Spiegel Haus Melbourne (online, over the phone, or at the venue), or via an authorised sales channel.

  1. Validity & Entry
    Spiegel Haus Melbourne reserve the right to refuse entry or cancel (without refund) any ticket reasonably believed to have been purchased from an unauthorised seller.
  2. Refunds & Cancellations
    In the case of an event cancellation, refunds will only be issued to the original ticket purchaser through Universe. Tickets purchased from unauthorised sellers are not eligible for refunds from Universe or Spiegel Haus Melbourne, and you may also be at risk of no refund from the unauthorised seller.
  3. Resale & Scalping
    Where Spiegel Haus Melbourne have reasonable grounds to believe that tickets are being purchased for the purpose of resale at a premium above face value, we reserve the right to block further purchases, cancel such tickets without refund, and refuse venue entry. Tickets may not be resold at a premium (including via unauthorised resale sites) or used for promotional, advertising, or commercial purposes without written consent.
  4. Purchase Limits
    Spiegel Haus Melbourne may impose limits on the number of tickets available per customer to ensure fair access. Purchases exceeding these limits may be cancelled without refund.
  5. Venue Information
    Spiegel Haus Melbourne will advise of any known sightline obstructions or restrictions prior to ticket purchase where applicable.
  6. Prohibited Practices
    The use of bots or automated purchasing methods is strictly prohibited. Tickets suspected to have been obtained in this way may be cancelled without refund, and entry to the venue refused.

Ticket Delivery & Collection

  1. Payment Requirement
    Delivery of tickets will only occur once full payment has been received.
  2. Delivery Methods
    The available ticket delivery method may vary by event. In most cases, tickets will be delivered digitally (mobile ticket or print-at-home).
  3. Box Office Collection
    If collection from the Spiegel Haus Melbourne box office is required, tickets will be available during standard operating hours and from one hour prior to the event. Collection must be made by the original credit card holder or an authorised representative. Proof of purchase may be required, including:
    • Confirmation email
    • Credit card used to make the purchase
    • Valid photo identification
    • Proof of concession entitlement (if applicable)
  4. Unique Identifiers
    Each valid ticket contains a unique identifier which permits a single entry only. If multiple copies of a ticket with the same identifier are presented, only the first scanned ticket will be admitted. All subsequent tickets may be denied entry, subject to verification.
  5. Identity & Proof of Purchase
    Spiegel Haus Melbourne reserves the right to request proof of identity and proof of purchase at the point of entry.
  6. Contact Information
    Spiegel Haus Melbourne may be required to collect personal information, including the first name and phone number of each person in the booking (including children), for contact tracing or other compliance purposes prior to ticket delivery

Pricing and Payment

  1. Currency & GST
    All prices are quoted in Australian dollars (AUD) and include GST where applicable. A tax invoice is available upon request.
  2. Price Changes
    Ticket prices are subject to change without notice.
  3. Handling Fees
    A handling fee may apply to each transaction. This fee will be disclosed to you prior to completing your purchase.
  4. Authority to Pay
    By purchasing a ticket, you declare that you have the authority to make the payment and that you own/hold or have the express permission of the owner/holder of, the credit card or other payment facility used.
  5. Incorrect Pricing
    If the amount you pay for a ticket is incorrect (whether due to an online advertising error, human error, or technical malfunction), Universe may cancel your order, refund the amount you paid, and, subject to availability, offer you the opportunity to purchase the ticket at the correct price.
  6. Dynamic Pricing
    During the course of ticket sales, prices may be adjusted in response to varying levels of consumer demand. These alterations do not affect the Terms and Conditions that applied to tickets purchased prior to the change and do not entitle you to a refund or partial refund of the difference between your purchase price and any subsequently adjusted ticket price.

Gift Vouchers

User Account

  1. Account Registration
    Prior to making an online purchase, you may be required to register for a user account and provide a valid email address and password.
  2. Confidentiality & Security
    You must maintain the confidentiality and security of your account details and must not share them with any other person. Universe and Spiegel Haus Melbourne will never request your account password.
  3. Responsibility for Use
    You are responsible for all use of the online purchase function and for all transactions conducted using your account.
  4. Unauthorised Access
    If you become aware of any unauthorised use of your account, you must notify Universe immediately and reset your password.

Lost, Damaged or Stolen Tickets

  1. Replacement Requests
    If tickets are lost, damaged, misplaced, or stolen, Spiegel Haus Melbourne may charge an administration fee to issue a replacement. Proof of purchase and proof of identity may be required before a replacement ticket can be provided.
  2. Limitations on Replacement
    Spiegel Haus Melbourne reserve the right not to issue a replacement ticket where:
    • The ticket is for general admission rather than reserved seating; or
    • The replacement request is not received within a reasonable time prior to the event.

Companion Card Program

  1. Affiliate Status
    Spiegel Haus Melbourne are affiliates of the Companion Card program and will admit carers to ticketed events as complimentary guests. This does not extend to additional items such as food & beverage packages, merchandise, or VIP events.
  2. Seating Requirement
    The companion must be seated in the nearest available seat to the Companion Card holder in order to provide support during their visit.
  3. Eligibility
    Use of a Companion Card is restricted to individuals who are unable to participate in an event at Spiegel Haus Melbourne without attendant care support. Full details of eligibility and use are available on the Companion Card website.
  4. Card Verification
    Only the person whose photograph and name appear on the Companion Card is permitted to use it. A valid Companion Card or Companion Card number must be presented at the time of purchase, upon ticket collection, and/or upon request to access the Companion Card program offer.
  5. Cardholder Presence
    The Companion Ticket is not valid unless the Companion Card holder is present at the event.
  6. Non-Compliance
    If the above requirements are not met, the Companion Ticket holder may be charged for the ticket.

Event Changes and Event Information

  1. Program & Artist Changes
    The hirer may add, withdraw, or substitute artists (including opening acts), or vary advertised programs, performance times, venue layout, seating arrangements, or audience capacity. Tickets will not be exchanged or refunded as a result of these changes, except as provided in these Terms and Conditions or as required by law (including the Australian Consumer Law).
  2. Seating Area Closures
    Seating areas at Spiegel Haus Melbourne may be closed with or without prior notice. If your ticketed seating area becomes unavailable, you will be relocated to another area of comparable value.
  3. Adult Content & Age Recommendations
    Information about events with adult themes or recommended age guidance for ticket holders will be available on the Spiegel Haus Melbourne website prior to ticket purchase.
  4. Restricted View
    Where a seat is deemed to have a restricted view of the performance and this is known to Universe or Spiegel Haus Melbourne prior to purchase, you will be advised of this information. If restricted view information becomes available after purchase, Spiegel Haus Melbourne may contact you directly to advise.
  5. Audience Engagement
    For some events, artists or hirers may encourage audience participation (e.g. standing, waving, dancing). This may impact visibility in certain seating locations.
  6. Latecomer Policy
    Latecomers may only be admitted at a suitable break in the performance and may be seated in alternate locations to avoid disruption.
  7. Re-admittance
    Once an event has commenced, admittance or re-admittance will generally only be permitted during a suitable break and may involve relocation to a different seating area. For some events, admittance or re-admittance may not be permitted at all.
  8. Refunds & Exchanges
    In any of the circumstances above, tickets will not be refunded or exchanged unless required by law (including the Australian Consumer Law).

Refund and Exchange

  1. Refunds & Exchanges
    1. General Policy
      Spiegel Haus Melbourne do not provide refunds after a purchase has been confirmed except as outlined in these Terms and Conditions or where required by law. Changes to personal circumstances, inability to attend an event, or change of mind do not constitute grounds for a refund.
    2. Rescheduled or Relocated Events (Intervening Circumstances)
      Where an event is rescheduled or significantly relocated due to Intervening Circumstances, Spiegel Haus Melbourne will advise you of a cut-off date for requesting a refund.
      • The cut-off date will be at least four (4) weeks from the date of the announcement, unless the new event is less than eight (8) weeks away.
      • If the new event is less than eight (8) weeks away, you must apply for a refund prior to the mid-point between the announcement and the new event date (e.g. if the new date is six weeks away, you will have three weeks to request a refund).
      • You will not be entitled to a refund if your request is made after the cut-off date.
    3. Rescheduled or Relocated Events (Other Reasons)
      Where an event is rescheduled or significantly relocated for reasons other than Intervening Circumstances, refunds will be provided as required by law.
    4. Cancelled Events
      If an event is cancelled, refunds will be provided as required by law.
    5. Exclusions
      Neither Spiegel Haus Melbourne, nor the event hirer will reimburse you for auxiliary expenses (such as travel, parking, childcare, or accommodation costs) or for any consequential loss related to attendance or non-attendance, unless required by law (including under the Australian Consumer Law).
    6. Refund Process
      • Refunds will only be paid to the original ticket purchaser.
      • Proof of identity and/or proof of purchase may be requested.
      • Refunds will be processed via the original method of payment. If the original payment was cash, refunds will be made by bank transfer.
      • Refunds may not be available immediately. A guide timeframe will be communicated, but reimbursement may vary depending on your financial institution. Spiegel Haus Melbourne cannot be held accountable for delays caused by financial institutions.
      • Refunds will be limited to the face value of the ticket plus any handling fee applied at purchase.
      • Refunds will not cover costs from external suppliers that you were not obliged to incur (e.g. express post, courier, or insurance fees).
      • Where tickets to multiple events are purchased in a single order, service charges will not be refunded.
    7. Exchanges
      For certain productions, tickets may be exchanged for different performances of the same production, subject to the following:
      • Exchange requests must be made at least 48 hours prior to the start of the originally ticketed performance.
      • All exchanges must be confirmed by Universe and Spiegel Haus Melbourne prior to the original performance start time.
      • Exchanges are subject to availability, blackout dates, sold-out performances, and other restrictions.
      • Exchanges cannot reduce the total number of tickets or downgrade the ticket category.
      • Complimentary tickets and resold tickets are not eligible for exchange.
      • Exchange policies may be changed or revoked without notice.

Merchandise and Other Products

  1. Refunds & Exchanges
    Merchandise and other products, including food and beverage items, will not be refunded or exchanged unless required by law (including the Australian Consumer Law).
  2. Third-Party Sellers
    Merchandise may be sold at Spiegel Haus Melbourne by third-party providers. In such cases, all queries regarding the product, refund, or exchange must be directed to the original point of purchase.

Promotions and Competitions

If you received your ticket or other product as a prize, gift, donation or otherwise at no cost, these Terms and Conditions and the terms and conditions of the relevant promotion or competition apply to your use of the ticket.

Voluntary Assumption of Risk

  2. Acknowledgement of Risk
    You acknowledge that attendance at any event and/or at Spiegel Haus Melbourne may involve certain dangers, including the risk of injury and damage to yourself or your property.
  3. Acceptance of Liability
    By attending an event and/or entering Spiegel Haus Melbourne, you accept the risk of damage or loss (including property damage, personal injury, economic loss, and consequential loss) however arising, including through negligence.
  4. Third-Party Acts
    This acceptance of risk extends to damage or loss caused by the acts or omissions of other ticket holders, visitors, guests, employees, or agents of Spiegel Haus Melbourne, or the event hirer.

Limitation of Liability

    To the extent permitted by law (including the Australian Consumer Law), Spiegel Haus Melbourne, and the event hirer are not liable for any loss, damage, injury, delay, additional expenses, or inconvenience arising from your attendance or non-attendance at Spiegel Haus Melbourne and/or the event.
  2. Minimum Liability
    Where liability cannot be excluded or modified by law, including under the Australian Consumer Law, the liability of Spiegel Haus Melbourne, and the event hirer is limited to the minimum extent permitted by law.
